1. Acceptance of terms
These Terms of Service ("Terms") govern access to and use of Gobelino, a Mobile Device Management (MDM) software for Android, by whoever creates an account and enrolls devices through the web panel (the "administrator"). By creating an account or using Gobelino, the administrator fully accepts these Terms. If you do not accept them, you must not use the service.
2. Description of the service
Gobelino lets an organization enroll, configure and monitor company-owned Android devices or the work profiles of its employees/collaborators, through a web panel and an agent app installed on the devices. It is designed in particular for use cases such as warehouse management, rugged device control, logistics kiosk lockdown, and AOSP fleet management.
3. Beta software — no warranty
Gobelino is currently under active development (beta). While it has been designed and tested with care, it may contain bugs, unexpected behavior, or malfunctions. Gobelino is provided "as is" and "as available", without warranties of any kind, express or implied, including — without limitation — warranties of merchantability, fitness for a particular purpose, service continuity, or freedom from errors.
4. Account and administrator role
Access to the panel requires creating an account, protected by a password and two-factor verification (2FA). The administrator is responsible for keeping their credentials confidential and for all activity carried out through their account.
5. Administrator responsibility
Whoever enrolls, configures, or manages devices through Gobelino (the "administrator") is solely and exclusively responsible for how the software is used, including — without limitation — the configurations applied, the restrictions set, the apps installed or removed, the activation of kiosk mode, locking/unlocking/resetting devices, and any other action performed on the managed devices.
The administrator is responsible for adequately informing device users about the management they are subject to, in compliance with applicable labor and data protection regulations, and for having an appropriate legal basis (e.g. consent, employment contract, company policy) to use Gobelino on their employees'/collaborators' devices.
If Gobelino is used to track device location, apply restrictions, remotely view or control a device's screen, or log the activity of employees or collaborators — for example in warehouse, logistics, or rugged device fleet management contexts — the administrator is also responsible for complying with any applicable labor law requirements on remote monitoring of workers: for example, in Italy, the works council agreement or Labor Inspectorate authorization required under Art. 4 of Law 300/1970 (the Workers' Statute) for tools capable of remotely monitoring employee activity. This applies in particular to the remote screen-view feature and to remote control (taps and swipes), described in section 5 of the Privacy Policy.
6. Acceptable use
The administrator agrees not to use Gobelino for unlawful purposes, to violate the rights of third parties, to covertly surveil individuals without an adequate legal basis, or to attempt to compromise the security of the service (unauthorized access, reverse engineering not permitted by applicable law, intentional overload of the systems).
7. Intellectual property
The Gobelino software, its code, design, and associated trademarks remain the property of their respective owners. Nothing in these Terms transfers to the administrator any intellectual property rights in the software, other than the right of use granted here.
8. Limitation of liability
To the maximum extent permitted by applicable law, Gobelino is not liable for indirect, incidental, consequential, or punitive damages, nor for data loss, malfunction, lockout, service interruption, or any other harm suffered by enrolled devices or their users, resulting from the administrator's use — correct, improper, or negligent — of the software. Nothing in these Terms excludes or limits liability for willful misconduct or gross negligence, where such exclusion is not permitted by applicable law.
9. Indemnification
The administrator agrees to hold Gobelino harmless from any claim, damage, or cost (including reasonable legal fees) arising from use of the service in violation of these Terms or of applicable law, including claims brought by users of the managed devices against the administrator.
10. Suspension and termination
The administrator may stop using the service at any time. Gobelino reserves the right to suspend or terminate access in case of violation of these Terms, unlawful use of the service, or non-payment (if and when applicable).
11. Changes to these terms
These Terms may be updated over time, particularly during the product's beta phase. The most recent version is always available at this same address. Continued use of the service after a change constitutes acceptance of the new Terms.
12. Governing law and jurisdiction
Unless otherwise stated, these Terms are governed by Italian law. Any dispute is subject to the jurisdiction of the courts where the service operator is legally based, subject to any mandatory consumer-protection provisions where applicable.
